Strata Titles Board holds that the MCST may allocate parking lots for various uses, not bound by BCA approved plans
In Wong Chee Kheong and another v The MCST Plan No. 4347 [2026] SGSTB 11, the Applicant subsidiary proprietors brought an application to the Strata Titles Board for 17 orders, including orders that it enforce the development's parking allocation in accordance with ‘applicable planning or regulatory approvals’. The Strata Titles Board dismissed all the 17 orders sought, holding that BCA layout plans were not binding on the Management Corporation in its allocation of paid/commercial parking versus season/residential parking, and affirming that the allocation of parking spaces is within the Management Corporation’s power under Section 29(1)(a)(b) of the Building (Strata Management) Act 2004 and/or paragraph 2 of the 2nd Schedule to the Building Maintenance (Strata Management) Regulations 2005.
