High Court clarifies application of the ‘2% proxy rule’ to company representatives in Strata-Titled Developments

This case update discusses the High Court’s decision in HC/RAS 5/2026, that the ‘2% proxy rule’ (which limits the number of subsidiary proprietors a proxy holder can represent via proxy) does not apply to representatives appointed by subsidiary proprietors which are companies.

 The High Court’s decision and the Magistrates’ Court decision from which the appeal arose are the first on the ‘2% proxy rule’ since it came into force on 1 February 2019.
